Wilton man pleads not guilty to manslaughter

WILTON -- A Wilton man involved in a fatal crash on Ridgefield Road pleaded not guilty Tuesday to manslaughter.

According to police, Gregory Dionisio, 21, of 221 Catalpa Road, was traveling northbound on Ridgefield Road at 7:28 a.m. on July 5 and crashed into 50-year-old Wilton resident Thomas Fleming, throwing him from his motorcycle. Both Dionisio and Fleming were transported to Norwalk Hospital, where Fleming "succumbed to his injuries shortly after arriving," according to police reports.

The grey 1989 Chevrolet Cavalier convertible driven by Dionisio was on the wrong side of the road at the time of the accident, according to police reports.

Dionisio, who turned himself in on Aug. 27 after learning there was a warrant for his arrest, was charged with manslaughter with a motor vehicle in the second degree while intoxicated, driving under the influence of alcohol and/or drugs, failure to drive right on a curve and failure to wear a seatbelt.

"There are not words to articulate the great sorrow and regret Gregory Dionisio has," said Pat Bonanno, Dionisio's attorney, at Norwalk Superior Court on Tuesday morning. "My client wishes to express the deepest remorse and regret for the Fleming family."

According to the arrest warrant affidavit, while being treated in the emergency area in the Norwalk Hospital, Dionisio attempted to drink his own urine. The affidavit stated that one of the emergency room nurses took the bed pan Dionisio was attempting to drink out of and submitted the urine sample to the hospital's lab. A search warrant was then issued for Dionisio's blood and urine samples, which were taken during his stay at the hospital.

The affidavit states that toxicology test results show the 21-year-old had a blood alcohol content level of .09 percent and tested positive for THC -- the main psycoactive drug in marijuana -- cocaine and ecstasy.

According to Bonanno, Dionisio has been seeking treatment at the Riverside Support Center in New York for physical and mental trauma due to this incident.

"This is a tragedy all around," said Bonanno. "It's a very complex case."

Jim Shillah, owner of Connecticut Coffee in Wilton who knew Thomas Fleming for many years, said he is outraged Dionisio is pleading not guilty.

"I feel terrible for the Fleming family," said Shillah, who attended the arraignment. "It is so obvious this kid is guilty. He had drugs in his system, he was drunk and he killed Tom Fleming. It amazes me he is pleading not guilty."

Chris Fleming, Thomas Fleming's brother, said he thinks justice will eventually be served in this case.

"Going to this trial brings back old memories and makes me think of the death of Tom two months ago that was just so unexpected," he said. "I have faith in the system and I think that justice will eventually be served -- maybe not to the degree I want it to, but it will be served."

Dionisio's case has been continued until Tuesday, Oct. 13 at Norwalk Superior Court.

NOT GUILTY? That kid ought to be ashamed of himself for denigrating Tom''s name like that. Get used to doing hard time kid. Your days of booze and drugs are over. Prison fights coming up and well deserved. Life over.

Why should his life be over.....supposed it was your kid....what about helping him to overcome his demons, and doing good for society....he will suffer in his heart forever.

What would be divisive? Drunk kills town hero. Drunk goes to jail. Nobody will be on the side of the drunk. End of story and end of drunk. Going to rehab AFTER you kill someone is not going to change anything. Too little, too late.

Wow, none of you have any compassion? His blood alcohol level was slightly above the legal limit and he had remnants of drugs in his system (marijuana stays in a persons body for up to 30 days.) Does he not deserve a fair trial before he "does hard time?" And whats with the "Mommy bailed him out of jail" snipe? Wouldn''t your mother bail you out? I think everyone should step back and wait until all the facts are out, before believing the Wilton Police Departments statements (these are the same guys who hold "seat-belt checkpoints" regularly, and give tickets out to normally law abiding citizens for not having the lap belt clicked in.)
I also think we should all remember that it wasn''t too long about that .1 was the legal BAC limit. And it wasn''t too long before that that .15 was. .09 means he had 4 or 5 drinks over 2 or 3 hours. Is that really that uncommon? Anyone who has had a couple of glasses of wine with dinner knows that that does not make a person too impaired to operate a vehicle. And yes, the drugs are bad. But those drugs could have been consumed days before and have no effect on a persons driving.

You have the b**s to call yourself "the rest of Wilton"? Justifying this idiot''s behavior because he was ''just'' over the limit at 7:20am on a Sunday morning? Compassion is for people that deserve it, prison is for people that kill other people. Read the accident report, you can get a copy from the Wilton Police Dept, and then tell us about compassion. Read: "no visible skid marks from Dionosio''s vehicle" while my brother had 2 second of full skid trying to get out of the way of this kid''s car flying at him. What about taking responsibility for one''s actions? I suppose the "rest of Wilton" doesn''t believe in that either. You can show your compassion by bringing poor little Greg something to read in prison.

Compassion? Yeah I have compassion for Tom''s wife & daughter, who happen to be my sister & niece, & Tom''s brothers & all his good friends that love & miss him. And talk about a fair trial...he killed a really good person, ask just about anyone in Wilton. That kid made an awful decision when he got behind the wheel of that car on the morning of July 5th, he was driving on the wrong side of the road, obviously those drugs & alcohol had an effect on him. He knows he''s guilty, why else would he try to drink his own urine. I hope & pray justice will prevail.

This is a terrible, terrible tragedy, no doubt about it. However, there are many of us who have gotten behind the wheel of a car when we shouldn''t have....and we were lucky....no one died. Think about it. Did any of you out there, that want this kid to rot in prison for all eternity, ever make such a mistake, and drive drunk or stoned??? He will pay for this for the rest of his life, in his heart and soul....he has to live with this horrible mistake and horrendous outcome. Mr. Fleming lost his life, and we all feel for his wife, daughter, and family...his life was tragicaly cut short....but why should this young man not be given the right to redeem himself? Should two people''s lives be ruined? I think not. He should pay for this crime, but be given an opportunity to go forward, and do good, and become a productive member of society. All of you are quick to say these terrible things about someone you don''t even know, someone that made a terrible mistake and has some problems that he is addressing. You''re very quick to judge him.... but, he could be any one of our kids, and you all know it. I have two teenagers, and I know anything is possible, and you are all fooling yourselves if you think otherwise. What if it was you kid????

Why wasn''t Mr. Fleming wearing a helmet....To me, that is a no brainer. I know in CT. it is not the law, but doesn''t it just make sense. Maybe he would have survived if he was wearing one. Just saying

True, anyone riding on a motorcycle should wear a helmet for their safety. Unfortunately in this accident a helmet could not have saved his life.
